Thank you for your interest in Ectopic Society Events S.R.L., the website www.ectopicsociety.ro (referred to herein as the "website" or "online site") and the products we sell through our online store. Before using or obtaining any materials, information, services through this website, please read the Terms and Conditions carefully. These provisions are in addition to the law 365/2002 on electronic commerce republished and amended and the GEO 34/2014 on consumer rights in contracts with professionals.

2. Acceptance of Terms and Conditions

The administrator offers you access to the site and implicitly to the online shop and its use, subject to your acceptance of these Terms and Conditions. By accessing, using, obtaining or purchasing any products, content, data, materials, information or services through our online site, you agree to be bound by the Terms and Conditions described in this material. The administrator reserves the right to add to or change any information on the site without prior notice to its users.

3. Copyright/intellectual property rights

All rights to the information provided through or on the website <www.ectopicsociety.ro> belong to Ectopic Society Events S.R.L. or have been assigned to Ectopic Society Events S.R.L. by third parties. By information is meant, but not limited to: photographs, images, videos, texts and any other similar material, i.e. works/objects/products of authorship, services and any mentions, i.e. their arrangement. By using the materials on this site (www.ectopicsociety.ro), users agree to comply fully with the limitations, conditions and requirements described herein. For all cases of copyright infringement, we reserve the right to claim compensation and sanctions according to the applicable law.
Ectopic Society Events S.R.L. makes a considerable effort to provide accurate and up-to-date data on its website, but does not assume responsibility for its accuracy and completeness and does not accept the right to complain about it. Ectopic Society Events S.R.L. does not guarantee that this website will always be accessible and available and that it will not contain errors or viruses. Each user expressly agrees to use this website at their own risk. The media and other users of this website expressly agree to indemnify Ectopic Society Events S.R.L. for any and all claims, costs, damages or liabilities arising from the negligent use of materials on the website by the same user, including any direct or indirect damages.
The Visitor/Buyer understands the intellectual property right and will not download/use the content of the Ectopic Society online site, images, descriptions, graphics, without the written consent of the administrator as they are the property of the administrator and are protected by copyright law and laws relating to intellectual and industrial property.

4. Remote contract perfection, validity in case of Ectopic Society online shop

With the launch of the order on the Ectopic Society online shop, the buyer accepts the communication by email or telephone through which the administrator conducts its business.

- This distance contract comes into force when the administrator confirms the order. Confirmation shall be made verbally (by telephone) or electronically (by email).

- The Terms and Conditions of the Ectopic Society online shop form the basis of the contract thus concluded.

- The administrator does not consider an unconfirmed order to be a Contract under any circumstances.

- We reserve the right to decide, unilaterally and without giving any reason, whether or not to conclude a sales contract. We shall have no liability to you if we refuse to act on an order.

- The buyer becomes the owner of the goods after confirmation of payment in the case of payment by PO or card or after payment and signature of the transport documents in the case of delivery by courier with cash on delivery.

5. Prices, payment methods, invoicing for the Ectopic Society online shop

- Prices are displayed on the product page, include VAT and do not include delivery charges unless expressly stated or offered as a bonus for large orders. If the price is not displayed, you will be able to request a quote and an operator will inform you of the price as soon as possible.

- The price of the product ordered is the price displayed at the time of placing the order.

- The price printed on the invoice is the same as the one sent by the operators when you confirm your order.

- The price of products in the Ectopic Society online shop may differ from the price in physical stores.
Payment methods are available on the order page.

- Based on the information held by Ectopic Society and that provided by the buyer, an invoice will be issued for the goods delivered. At the same time, the parcel will be accompanied by the documentation required by law for the product(s) ordered, as appropriate: certificate/declaration of conformity, guarantee certificate, instructions for use, etc.

The products/items/services on www.ectopicsociety.ro can be purchased using the following payment instruments:

Refund (cash) on delivery of the parcel.

By Bank Transfer

Payment is made by bank transfer on the basis of the proforma invoice, delivery of the products will be made after the amount (total invoice value) has been credited to our account.

By Bank Card

For payments by credit/debit cards issued under the Visa and MasterCard (Visa/Visa Electron and Mastercard/Maestro) or any other bank cards accepted for payment by LibraPay, the LibraPay online payment processing system is used. In order to be able to use the LibraPay service and related facilities, bank card data (card number, expiry date, cardholder name) will be stored. This data will not be disclosed to third parties and for maximum security the security code (CVV2, CVC2) will not be stored.
By selecting the "Activate Quick Payments Option" checkbox on the LibraPay online payment form or by completing the steps that involve creating an account in the LibraPay Wallet application, the user agrees to the activation of the LibraPay Wallet account, through which online payments can be made to LibraPay partner merchants, including by entering the CVC2/CVV security code.

Cash on delivery

The value of the products and services ordered can be paid to the courier on delivery to the address you specify.

6. Stocks in the Ectopic Society online shop

Products are in stock. However, the administrator cannot guarantee the availability of posted products. Customers are correctly informed, according to the terms and conditions, of the availability of the products ordered before delivery is confirmed. Rarely, miscommunications may occur in this regard.

7. Ectopic Society online shop guarantees

Ectopic Society Events S.R.L. guarantees that the products delivered are original, sealed (in the form in which they come from the partners) and accompanied by a tax invoice, receipt (issued by the administrator or courier company) and, where applicable, a guarantee certificate (for products requiring a guarantee).

We declare on our own responsibility according to the provisions of art. 5 of GD no.1022/2002 on the regime of products that may endanger life and health, work safety and environmental protection that the products delivered do not endanger life, health, work safety, do not have a negative impact on the environment and are in conformity with: EC Directives 67/549/EEC and 1999/45/EC (subject to compliance with the handling, transport and storage as specified for each service/product).

The quality of the products marketed is guaranteed for the period of time indicated on the packaging, provided that they are used, stored and transported in accordance with the instructions.

8. Information on exercising the right of withdrawal

These provisions are supplemented by GEO 34/2014 on consumer rights in contracts concluded with professionals and by GEO 58/2022 amending and supplementing certain consumer protection acts and by Decision No 686/2022 amending and supplementing Government Decision No 947/2000 on the method of indicating the prices of products offered for sale to consumers.

Return policy

According to GEO 34/2014 you have the right to withdraw from this contract, without giving reasons and without penalty within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier, indicated by you enter into physical possession of the products.

To exercise your right of withdrawal you must inform us of your decision to withdraw from this contract using an unequivocal statement, for example, a letter sent by post or email. For this purpose, you can use the enclosed withdrawal form, but its use is not mandatory.
In order to respect the withdrawal deadline, it is sufficient to send the communication on the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw, we will refund any sums we have received from you, including the costs of delivery, except for additional costs arising from the fact that you have chosen a method of delivery other than the cheapest standard type of delivery offered by us, without undue delay and in any event no later than 14 days from the date on which we are informed of your decision to withdraw from this contract.

Additional costs are any costs (transport, delivery, reduction in the value of the products resulting from handling other than those necessary to determine the nature of the qualities and functioning of the products, postal or any other charges) to be borne by the consumer when exercising the right of withdrawal.

Courier costs are non-refundable. We will make this refund using the same method of payment as that used for the original transaction, unless you have expressly agreed to another method of refund; in any case, you will not be charged a fee as a result of such a refund.

We may postpone the refund until the date we receive the goods back or until you have provided us with proof that you have returned the goods, whichever is the earlier.

If you have received products in connection with the contract, ship the products or deliver them directly to us at any of the locations listed on the Contact page of www.ectopicsociety.ro, without undue delay and in any event no later than 14 days from the date you notified us of the withdrawal. The deadline is met if the products are returned before the 14-day period has expired.

The conditions of the right of withdrawal apply only to natural person consumers, as defined in Article 2, point 1 of GEO 34/2014.

You will have to bear the direct cost of returning the products. The consumer is responsible for the integrity of the product until it enters the possession of the shop.

You are responsible for any diminution in the value of the products resulting from handling other than that necessary to determine the nature, qualities and functioning of the products.

At the request and with the consent of the consumer, Ectopic Society Events S.R.L. may recommend to the buyer the purchase of another product of equivalent quality and price to that requested in the first order. The initial order will be cancelled on the date of confirmation of the order of the product(s) replacing the initial product.

If you are thinking of returning the product, do not use it! You may not use the products you have received before you have made a decision on whether to cancel the purchase contract. The right of withdrawal exists to allow you to examine the product as you would in a shop, not to give you 14 days free use.

Products cannot be returned if:
- have been the subject of a special order
- have been distinctly personalised at the consumer's request
- have been made to the consumer's specifications (e.g.: the product has been coloured in the colour requested by the customer)
- show signs of knocks, damage or wear
- have been unsealed and no longer have the original packaging intact, with all accessories and label intact
- are put by any means in a condition unsuitable for resale

For products collected by the buyer directly from the shop, as the buyer has the opportunity to check the product directly, the return conditions set out in this section do not apply.

Ectopic Society Events S.R.L. will bear the costs of return if this is attributable to it. (The products received do not correspond to the order, are other than those requested by sending it).

9. Work schedule, deliveries, deadlines

- An order can be placed at any time, but the processing period is Monday to Friday between 8am and 4pm, excluding public holidays.

- Products available in the online shop can be delivered by Ectopic Society fleet in the specified area or by couriers.

- Delivery time for products is 48-72 hours from the time of delivery confirmation.

- In the case of e-tickets, they can be downloaded and then printed. Please use a printer that can print legible markings and inscriptions (barcode, QR code, etc.) on the ticket to ensure easy identification when entering the event.

- Physical deliveries are made door-to-door, by express courier, outside the distribution area via the Ectopic Society fleet - outsourced service therefore independent of the administrator. There may be delays in relation to the delivery deadline set at the time of order confirmation; in this case the administrator assumes no liability on behalf of the courier companies.

- The administrator assumes responsibility for the delivery of products ordered by the buyer. The risk of loss of the goods shall pass to the buyer when the goods are actually delivered.

10. Obligations of the buyer

- To provide true, accurate and current information about his entity when requested, otherwise orders may be refused;

- To accept the resolution of any problems within 30 days from the date of their referral by email to the administrator;

- To accept the Terms and Conditions of the administrator once the orders have been placed and to pay for the goods by the methods made available at the time the order is placed.

11. Obligations of the seller

- To make professional information on its products and services available to users free of charge. The content published in the online shop is for guidance only. The characteristics of the products and their technical documentation displayed on the site are provided by the manufacturers and suppliers. Product images are displayed for presentation purposes only. Depending on the batch in which they were manufactured, the actual appearance of the product may differ.

- Contact customers for order confirmation by email or telephone.

- Deliver products within 30 days of confirmation of delivery if they are in stock.

- To use personal data collected from customers/users in accordance with the `Confidentiality` section, which is an integral part of the Terms and Conditions.

12. Litigation

The Terms and Conditions are subject to Romanian law. In case of dispute, if the amicable settlement is not effective after registration of the complaint at the company's headquarters, the court of Ectopic Society Events S.R.L. will be used.

Ectopic Society Events S.R.L. is not liable for damages caused through no fault of its own, for the non-functioning of the online site or for those resulting from the impossibility of accessing the pages of the virtual shop (e.g.: Internet network breakdowns). Force majeure shall exonerate the party invoking it from liability.
